Canada (Commissioner of Patents) (the so-called ‘Harvard Mouse’ case), the Canadian Courts were soon asked to re-consider the issues surrounding the patentability of biotechnological inventions in Monsanto v. Schmeiser. Unlike Harvard Mouse, this matter was an infringement action.
